THE DISPOSITION OF THE IMAGE COPYRIGHT AFTER DEATH IN THE AUDIOVISUAL INDUSTRY AND THE LEGAL REPERCUSSIONS

Abstract

Digital resurrection is the process of creating a virtual replica of a deceased person in order to preserve their presence after death. It has been used in audiovisual media as a way of bringing famous people "back to life" in films and advertising campaigns. This practice has raised ethical and legal questions and the purpose of this article is to analyze the legal implications of digitally recreating people after death, examining the protection of post-mortem image rights, the rights and obligations of heirs, the impacts on the audiovisual industry and the need to regulate the practice.
